Learned advocate appearing for the petitioner submits that although the State is trying to impress upon this Court that there are criminal antecedents of the present petitioner but the petitioner is on bail in rest of the cases.
Today a report has been submitted which reflects in 5 of the cases petitioner has been granted bail and petitioner is presently detained only in connection with the instant case.
Learned advocate appearing for the petitioner further submits that petitioner is in custody for 506 days and the quantum of Codine Phosphate recovered so far as the present petitioner is concerned is 1.337 Kgs.

Learned advocate for the State opposes the prayer for bail.
Having considered the period of detention of the present petitioner I am of the view further detention is unwarranted.
As such the prayer for bail of the petitioner is allowed. Petitioner, namely, Md. Mumtaz shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Court (under NDPS Act), Barrackpore, 24 Parganas North.
If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of 24 Parganas North without the prior permission of the learned Special Court.
Accordingly, CRM (NDPS) 1039 of 2025 is allowed.
Report submitted by the State be kept with the record.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
