Mr. Pawan Sanwal, Advocate, i/b Mr. V.S. Rawat, Advocate for the respondent no. 4. (2) Petitioner has challenged recovery certificate issued by Executive Officer, Nagar Palika Parishad, Uttarkashi. By the said certificate, recovery of ₹3,14,880/- was requested to the Collector. Petitioner has challenged the said recovery certificate on the ground that rent of a shop, let out to the petitioner by Nagar Palika Parishad, cannot be recovered as arrears of land revenue. Reliance is placed upon Section 173A of Uttarakhand Municipalities Act for contending that rent cannot be recovered as arrears of land revenue. (3) Learned Counsel for the Nagar Palika Parishad, however, refers to Section 292 of Uttarakhand Municipalities Act, which provides for recovery of rent of other immovable property, which can be recovered in the manner prescribed by Chapter VI. (4) Since the issue involved in this writ petition is already dealt with by this Court in WPMS No. 3583 of 2023, therefore, this Court do not find any reason to interfere with recovery certificate. However, writ petition is disposed of with liberty to petitioner to make representation to the Executive Officer concerned on the question of quantum of payment. If petitioner makes such representation within ten days from today, decision thereupon shall be taken, as per law, 2026:UHC:297 within six weeks thereafter. Till decision is taken on petitioner’s representation, no coercive step shall be taken against the petitioner pursuant to impugned recovery certificate.
