The instant writ application has been preferred for following reliefs:
“(i) For issuance of appropriate writ (s), order (s), direction (s) specifically a writ in the nature of mandamus, directing and commanding upon the respondent authorities to fix and pay the petitioners the grade pay of Rs. 2800/-, instead of present Rs. 2400/- , at the entry level Upper Division Clerks post (appointed prior to 10.07.2004), working in different offices under the School Education and Literacy Department of State of Jharkhand, in Palamu Division, treating them at par with the UDC in other Departments of the State Govt. (appointed prior to 10.07.2004), as far as payment of entry level salary is concerned, as in other department the similarly situated upper division clerks have been categorized to be paid Rs. 5200-20200/- in P.B.-I with grade pay of Rs. 2400/- improved to Rs. 2800/- on confirmation of their services, while the petitioners, though similarly situated, are being paid the same scale and pay band, but in the lower grade pay of Rs. 2400/-, even after confirmation of their services. (ii) For issuance of appropriate writ (s), order (s), direction (s) specifically a writ in the nature of mandamus, directing and commanding upon the respondent authorities to grant the benefit of MACP, in accordance with and in consequence of improved entry level grade pay, prayed for in Para-1 (i), of Rs. 2800/-, in the next higher grade pay of Rs. 4200/-, instead of grade pay of Rs. 2800/- that the petitioners are now getting, in first MACP.”
2. During pendency of the writ application, one order was passed on 29.09.2023 and also a notification has been issued on 20.09.2024, which is a fresh cause of action. 3.
Accordingly, due to want of instruction, learned counsel for the petitioner submits that interest of justice would be sufficed by giving liberty to the petitioner to challenge same, if so advised. 4.
