Heard Mr. M K Das, learned counsel representing the applicant. Also heard Mr. B Sarma, learned Additional Public Prosecutor, Assam. This application has been filed under Section 483(1)(b) of the BNSS, 2023 praying for modification of the order dated 08.06.2017 passed by this Court in BA No. 630/2017. By the said order, the applicant was granted bail with the condition that the applicant shall not leave the jurisdiction of the Trial Court without its prior permission. The applicant Smti Kishori Baruah, aged about 62 years, has submitted that it is difficult for her to take permission from the Trial Court whenever she goes out of the station. Therefore, she prays that this condition may be modified. I have considered the submissions made by the learned counsel of both sides. Also, I have gone through the relevant materials available in the records. This court is of the opinion that the aforesaid condition deserves to be modified. Therefore, the prayer of the applicant is allowed. The applicant Smti Kishori Baruah shall have the liberty to go out of the jurisdiction of the Trial Court without its permission. Accordingly, the condition aforesaid is modified. The interlocutory application is disposed of.
