The petitioner is apprehending his arrest in connection with Tisra P.S. Case No. 59 of 2023, registered for the offence under Sections 414/34 of the IPC, Sections 4 and 21 of MMDR Act, Section 9 and 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in the court of learned Judicial Magistrate, 1st Class, Dhanbad. 3. Learned counsel appearing for the petitioner submits that the petitioner is the driver and allegation is made of loading of 20-30 tone coal. She submits that owner of the said truck has already been granted anticipatory bail in A.B.A. No.1463 of 2024. She further submits petitioner is having no criminal antecedent as disclosed in para 10 of the petition. She also submits that the petitioner is earning his livelihood by driving vehicle. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are thereof fleeing away leaving the truck. 5. Considering that the petitioner happens to be driver and has got no criminal antecedent as disclosed in para 10 of the petition and it has been pointed that that the petitioner earns his livelihood by way of driving the vehicle and the owner of the said truck has been granted anticipatory bail in A.B.A. No.1463 of 2024, and in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
