1. The petitioners have filed these bail applications under Section 483 of BNSS in FIR No.19/2026 registered at Police Station CPS Jaipur, District ACB District for offences under Sections 7, 7A, 8 of PC Act, 1988 and Section 61(2) of BNS, 2023.
[2026:RJ-JP:12367] (2 of 3) [CRLMB-2401/2026]
2. Since both these bail applications arise out of common FIR, hence, they are being decided by this common order.
3. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.
4.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in these cases. He again submits that both the petitioners are private individuals and are not employed in any public office. He further submits that there was no recovery from the present petitioners, and that the FIR has been lodged against them on false and concocted grounds merely on the basis of certain bank transactions i.e. amount of Rs. 9,400 in the account of Nirmal Kumar and Rs. 1,01,500 in the account of Ramu Ram under suspicious circumstances. He further submits that no demand has been raised by the petitioners. The petitioners are behind the bars since 09.01.2026 without any criminal past. Charge-sheet has already been filed. The trial of the case will take considerable time and in absence of any incriminating evidence against the petitioners, therefore, the bail applications of the petitioners deserves to be allowed.
5. Learned Public Prosecutor has vehemently opposed the bail application.
6. On consideration of the rival submissions and material available on record and in the light of submissions made by
learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.
7. Consequently, the bail applications under Section 483 B.N.S.S. are allowed and it is directed that the petitioners Nirmal
