JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs: a) Issue a Writ of certiorari order or direction in the form of writ quash the impugned order dated 28.08.2025 passed by the Respondent No.3 vide bearing No.B12(2)/PR/E- 131633/2025-26 under Annexure-A. b) any other relief/s as the Hon'ble Court deems fit under the circumstances of the - 3 - HC-KAR NC: 2026:KHC:8646 WP No. 38716 of 2025 case in the ends of justice including the cost of the Writ Petition. 2. The grievance of the petitioner is that the petitioner has been replaced as president of respondent No.5- Association by respondent No.3 which could not have been so done. 3. The submission of learned counsel for the petitioner is that the petitioner being the president of respondent No.5 is required to continue as president and represent respondent No.5, despite his retirement. 4. I am unable to accept the said submission of the learned counsel for the petitioner, inasmuch as it is only a serving employee who can represent the interest of the employees before the employer and not a person who has retired. 5. It does not augure well for a retired person to cling on to the post of the president of respondent No.5 to try and represent the interest of the working employees. - 4 - HC-KAR NC: 2026:KHC:8646 WP No. 38716 of 2025 6. It is not that respondent No.3 has removed the petitioner as the president of respondent No.5, the petitioner having retired automatically would cease to be a member of respondent No.5. Insofar as the employer is concerned, having no authority to deal with the employer for himself or on behalf of the other employees. 7. No grounds being made, the petition stands dismissed.
