The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending her arrest in connection with Crime No.1004/2024, registered at Police Station Civil Lines, Bilaspur, District Bilaspur (C.G.) for alleged commission of offence punishable under Sections 21, 22 & 29 of the N.D.P.S. Case of the prosecution, in brief, is that on 21.10.2024 the police received secret information about selling of intoxicant substance by Shrishti @ Moti near the income tax office bearing two wheeler Activa No. CG-10- BQ-1687, the police reached the spot and recovered 150 ampule of intoxicant substance from the possession of co-accused and co-accused failed to produce valid documents in respect of the recovered intoxicant substance. Thus, the offences u/s 21, 22, & 29 of the N.D.P.S. Act, 1985 has been registered against the accused persons and after full investigation the challan /charge sheet has been filed before the trial court by the police. 3. It is argued by learned counsel for the applicant that the applicant who is a lady has come up before this Court for grant of anticipatory bail on the ground that notice has been served to her under Section 67 of the NDPS Act for the purpose of interrogation by the Station Officer of the concerned Police Station dated 24/06/2025. It is submitted that the applicant is neither named in the FIR nor charge sheet has been submitted against her. It is further submitted that one of the co-accused namely Kajal Kurre who was also a lady, this Court has granted regular bail in MCRC No.4265/2025 on 30/06/2025. It is further submitted that the applicant is a permanent resident of address mentioned in the cause title and there is no likelihood of absconding, the applicant undertakes to abide by any conditions imposed by this Court, therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail and submitted that the notice which has been 3 served for appearance of the applicant for the purpose of interrogation under Section 67 of the NDPS Act is dated 24/06/2025 and for more than 10 months, the applicant has not appeared before the trial court and has come up before this Court for grant of anticipatory bail, therefore, the applicant is not entitled for the benefit of anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts & circumstances of the case, submission of learned counsel for the parties, materials available on record, the fact that one of the co-accused namely Kajal Kurre who was also a lady this Court has granted regular bail in MCRC No.4265/2025 on 30/06/2025 but considering the fact that the notice is dated 24/06/2025 and the applicant has only been called for interrogation purpose and she appears to have avoided the notice and not appeared, therefore I am not inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the anticipatory bail application of the applicant - Shikha Gaud, involved in Crime No.1004/2024, registered at Police Station Civil Lines, Bilaspur, District Bilaspur (C.G.) for alleged commission of offence punishable under Sections 21, 22 & 29 of the N.D.P.S.
