THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE and HON'BLE MR. JUSTICE C.M. POONACHA ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. The complainant has filed the present complaint alleging willful disobedience of the order dated 30.01.2025 passed by the learned Single Judge of this Court in W.P.No.22806/2024 (KLR- RR/SUR). The operative part of the order is as under: i) The writ petition is hereby allowed; ii) Respondent No.4 the Tahsildar, is directed to immediately verify the records, specifically reviewing Annexure-A (RTC), and take note of the relevant details therein; and iii) Respondent No.4 is further directed to consider the petitioner's representation forthwith, expedite the - 3 - HC-KAR NC: 2026:KHC:10004-DB CCC No. 818 of 2025 necessary inquiry, and pass appropriate orders in accordance with the law within a period of one month from the date of receipt of a copy of this order. 2. The accused has now filed an affidavit in compliance, inter alia, affirming as under: "5. I state that subsequently on 04.12.2025, the case of the Complainant / his representation dated 23.11.2023 has been reconsidered taking into account Para-4 of the order dated 30.01.2025 and an endorsement has been issued to the Complainant stating that since the complainant has failed or not performed to pay the requisite fee insofar as the confirmation of grant made to him in the order 1974. Even after receipt of the notice dated 08.04.1974 by the father of the complainant who is the original grantee in respect of land in question failed to pay the requisite fee so as to consider his case for issuance of saguvali chit. 6. I further state that, in view of the non-payment of saguvali chit the name of the original grantee has not been entered in Column No.9 of the RTC. In view of the said non payment of requisite fee to the Government / stating there is no scope to consider the case of the complainant to issue Saguvali chit into his same. In view of the said facts and circumstances the case of the Complainant / his representation dated 23.11.2023 has been duly considered and an endorsement dated 04.12.2025 has been issued to the complainant by way of registered post. The copy of the endorsement dated 04.12.2025 and the postal receipt dated 04.12.2025 is herewith produced and marked as Annexure-R1 and R2." - 4 - HC-KAR NC: 2026:KHC:10004-DB CCC No. 818 of 2025 3. In view of the above, the complainant's request for issuance of a Saguvali Chit has been considered and rejected. 4. We are unable to accept that any proceedings for willful disobedience of the order are required to be initiated against the accused in the given facts. The complaint is accordingly closed. 5. We, however clarify that this order will not preclude the complainant from availing of the statutory remedies in respect to the endorsement issued by the accused.
