The present Writ Petition is filed questioning the inaction of Respondents in considering the representation given by the Petitioner, seeking for sanction of compassionate allowance, gratuity and other pensionary benefits, as illegal and arbitrary. 2. The Petitioner was initially appointed as Armed Reserve Police Constable in Guntur district and was transferred (on mutual basis) to Armed Reserve, East Godavari district on 06.01.2001. As the Petitioner did not report to the duty, upon conducting enquiry, he was removed from service vide proceedings in D.O.No.292/2015, C.No.04/OE-PR/2014, dated 30.09.2015. The said order was confirmed in appeal and revision filed thereon. 3. The Petitioner then filed W.P.No.16156 of 2021 before this Court and the same was dismissed on 13.02.2023. No further appeal was filed thereon. Thereafter, the Petitioner gave representations for considering his case for grant of compassionate allowance, gratuity 4 and other pensionary benefits under Rule Nos.40, 41 and 45 of Andhra Pradesh Revised Pension Rules, 1980 (for short, ‘the Rules’). As the representations given by him were not being considered, the present Writ Petition came to be filed. 4. Learned Government Pleader for Services submitted that the representations given by the Petitioner would be examined and an appropriate decision will be communicated to the Petitioner. 5. Heard the counsels. 6. The Rule No.40 of the Rules provides for compassionate allowance not exceeding 2/3rd of pension/gratuity or both. This is an aspect to be considered by the disciplinary authority. Considering that the Writ Petition is confined only to examine the representations submitted by the Petitioner, this Writ Petition is disposed of, with the following directions:- (i) The Respondent-Authorities are directed to examine the representations submitted by the Petitioner and to communicate the decision, within a period of three months from the date of receipt of a copy of this order. 5 7. No order as to costs. 8.
