By this petition, the petitioners have challenged the notice dated 25.07.2026 issued by respondent No.2- Senior Police Inspector, Police Station, Hudkeshwar, Nagpur City. 2. Heard learned counsel for the petitioners who submitted that the impugned notice dated 25.07.2026 shows that the Investigating Officer has directed the petitioners to take an appropriate decision in view of the demands made by the employees. He submitted that the disciplinary action is under way against the employees and the Police Officers are no way concerned to issue such type of directions to the petitioners. Therefore, the notice issued is beyond the scope of Section 168 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and therefore, it requires to be quashed and set aside. 2 8 cr wp no. 600.26.odt..odt
3. Learned APP submitted that the concerned Police Station Officer has issued notices to the petitioners as well as employees and request was made to them to maintain the law and order. The notices were issued only to maintain the law and order. He further pointed out that the employees were also requested by the concerned Police Station Officer to take an appropriate action in the Court instead of indulging into the illegal activities. Thus, he submitted that it is a scope of Section 168 of the Bharatiya Nagrik Suraksha Sanhita, 2023 to prevent the cognizable offence the notices are issued. Therefore, there is no illegality committed by the concerned Police Station Officer. 4. After hearing both the sides and on perusal of the notices which are issued on 25.07.2026 to the present petitioners as well as employees. It is also apparent that said notices are issued to prevent the cognizable offences. As far as disputes between the employer and employees are concerned, admittedly, the concerned Police Station Officer has no concerned with it and if the employees are having any grievance they can approach to the appropriate Forum. Thus, considering the intention behind the said notice issued by the Senior Police Officer, Police Station Hudkeshwar which apparently shows that it was issued to prevent the cognizable offence. Therefore, we do not find any illegality in the said notice. 5. However, we clarify that the Police Station Officer shall not indulge into what action the employer has

6. With this direction, Criminal Writ Petition stands
disposed of.
