JUSTICE GANESH RAM MEENA Order 10/04/2026 1. This bail application has been filed by the accused petitioner under Section 483 BNSS in connection with FIR No.79/2025 registered at Police Station Basdayal, District Kotputli- Behror, for offence under Sections 103(1), 329(3), 191(2), 191(3) and 190 of B.N.S., 2023. 2. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that the present petitioner is an old aged person of 76 years and is in custody since 17.06.2025. He further submits that the deceased has sustained injuries in an accident. He also submits that the police after completion of investigation, has submitted charge-sheet in the matter and trial of the case will take time to conclude, therefore, he may be enlarged on bail. The learned Public Prosecutor has opposed the bail application and submits that as per the statement of the eye witness, Arjun, recorded under Section 180 B.N.S.S., 2023, the accused petitioner made attack on the deceased, inflicting injuries with knife on chest and neck. He also submits that as per the postmortem report, the cause of death is a shock, resulting from injury on chest and neck. 4. Considered the submissions made at bar and also perused the material made available on record. 5. During investigation, it has come out that one of the eye witness, Arjun, has stated in the police statement that the present petitioner attacked on the deceased and inflicted injuries with knife on chest and neck. The version of the eye witness is supported by the postmortem report, wherein the deceased sustained injuries on the chest and neck, including the sharp weapon injuries. As per the postmortem report, the cause of death is shock due to injury which is said to be caused by the petitioner. 6. In view of the above, this Court is not inclined to enlarge the petitioner on bail. 7. Accordingly, the present bail application is dismissed. (GANESH RAM MEENA),J ARTI SHARMA /66
