Order No.
01.
ORDER 17.03.2026
The auction purchaser is knocking at the doors of Writ Court for a direction to the DRT to dispose off S.A. No.107 of 2017, wherein he happens to be one of the opponents.
2.
Learned counsel for the Petitioner submits that right to speedy justice being a part of Article 21 of the Constitution of India, long pendency of matters like this, is not desirable, even in view of the Parliamentary Policy enacted in SARFAESI Act, 2022. We agree.
3. Notice to other side is dispensed with, inasmuch as no effective order is being passed against them, what is being passed is to pass an order on the pending S.A, keeping open all
contentions of the parties.
In the above circumstances, this petition is disposed off, requesting the DRT, Cuttack to take all steps for expeditious disposal of S.A. No.107 of 2017 within an outer limit of six months. All contentions of the parties are kept open. p. 2 Registry to send a copy of this order to the OPs by speed post and the said OPs may seek recall of this order, if grounds do exist therefor, since this order has been passed ex-parte.
