ORDER (ORAL)
1. Mr. S.D. Upadhaya, learned Legal Aid Counsel has submitted that this instant application has been filed with a prayer for condonation of delay of 883 days in filing the related appeal after being convicted by the learned Special Judge (POCSO), West Khasi Hills District, Nongstoin vide
judgment dated 05.01.2024 and order of sentence of even date. The ground cited being that the applicant could not approach this Court within the stipulated period due to financial constraint and finally after exhausting all means has sought for legal aid which is done so now. It is prayed that the aforementioned delay may be condoned.
2. Mr. N.D. Chullai, learned AAG assisted by Ms. R. Colney, Addl. P.P has no objection to the prayer made.
3. Accordingly on consideration of the submission made and on perusal of the pleadings made in this application, this Court is persuaded to allow the prayer made. The delay as stated is hereby condoned.
4. Misc. Case disposed of.
