The present criminal misc. application has been filed by the applicant seeking a direction to expedite and conclude the proceedings of Complaint Case No. 727 of 2025, under Section 318 of BNS, pending in the Court of learned 3rd Judicial Magistrate, Dehradun. 4. Learned counsel for the applicant would submit that applicant had lodged a complaint against the respondent. After investigation, respondent was summoned under Section 318 of BNS. Thereafter, despite service of summons, the respondent failed to appear before the learned court and as such bailable warrants were issued and after that non- bailable warrants were also issued against the respondent and proceedings under Section 83 and 84 of Cr.P.C. were initiated. Then again, respondent appeared before the court concerned and secured her bail and gave her undertaking before the court concerned that respondent will appear on the next date fixed i.e. on 07.05.2026, but, again on 07.05.2026, she did not appear. It is further submitted that the summoning order was issued on 15.07.2025. On this basis, learned counsel for the applicant would submit that respondent is deliberately prolonging the proceedings of the case and the prolonged pendency of the trial is causing continuous uncertainty and hardship to the applicant. Thus, it would be expedient if the trial is concluded expeditiously. Hence, a direction for expeditious disposal of the case has been prayed for. 5. Heard learned counsel for the parties and perused the record. 6. After hearing learned counsel for the parties and after perusing the material available on record, this Court finds the prayer sought by the applicant to be innocuous. 7. Having considered the submissions advanced by learned counsel for the applicant, this Court is of the view that the interest of justice would be served by directing the trial court to expedite the proceedings. 8. Accordingly, the present criminal misc. application is disposed of with a direction to the court concerned to make all possible endeavours to conclude proceedings of Complaint Case No. 727 of 2025, under Section 318 of BNS, pending in the Court of learned 3rd Judicial Magistrate, Dehradun, as expeditiously as possible, preferably within a period of one year from the date of production of a certified copy of this order, without granting unnecessary adjournments to either party. 9.
