JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court, seeking the following prayers: In W.P.No.24248/2025: "a. Issue a Writ of Certiorari for quash the FIR, filed by the Respondent No. 2 in Crime. No. 189/2025 dated 31.05.2025 against the Petitioners by the 2nd Respondent Police for offences punishable 115(2), 3(5), 351(2), 351(3), 352, 74 of the Bharatiya Nyaya Sanita, 2023 (BNS), pending on the file of XXXI ACMM, Bengaluru in so far as the Petitioner concern vide ANNEXURE - B1 and all further actions initiated by the 2nd Respondent Police. b. Issue a writ of mandamus directing the Respondent No.1 to investigate the complaint given by the Petitioners in Crime No.200/2025 (ANNEXURE-A), to be investigated either by any superior police officer or a separate Investigative Agency other than Respondent No. 3, in the interest of justice and equity. c. In Crl.P.No.7786/2025: a) Quash the FIR in Crime No.200/2025 registered by the Rajagopal Nagar Police Station, Bengaluru against Petitioners for the offences punishable under Section 115(2), 351(2), 351(3), 352 read with 3(5), 74 of the Bharatiya Nyana Sanhita (B.N.S.) Act, 2023 on the file of 31st Addl. CMM, Bengaluru City; b) Grant pass such other order or orders as this Hon'ble Court may consider it to be just and proper, having regard to the proved and admitted facts and circumstances of the case, in the interest of justice and equity." 2. Heard Sri. Shivaramu H.C., learned counsel appearing for the petitioners, Sri. B.N. Jagadeesha, learned Addl. SPP appearing for respondent Nos.1 to 3, Sri. Prasanna D.P., learned counsel appearing for respondent No.4 in W.P.No.24248/2025 and Smt. Shilpa Rani, learned counsel appearing for the petitioners, Sri. B.N. Jagadeesha, learned Addl. SPP appearing for respondent No.1, Sri. H.C. Shivaramu, learned counsel appearing for respondent No.2 in Crl.P.No.7786/2025 and have perused the materials on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have - 6 - HC-KAR NC: 2026:KHC:21781 WP No. 24248 of 2025 C/W CRL.P No. 7786 of 2025 filed the joint affidavit. The joint affidavit so filed reads as follows: “JOINT AFFIDAVIT FILED BY THE PETITIONERS AND RESPONDENT NO.2 I, Pradeep U.M s/o S.K. Manjunath, aged about 46 years and Raghavendra U.M s/o S.K. Manjunath, aged about 44 years, Vanitha U.M W/o Sri. Prashanth, aged about 36 years, Petitioner No.1 to 3 all are residing at No.122, C.M.C. 573, 3rd Cross, Rajivgandhi Nagar, Laggere, Bengaluru-560 058, and Manjunath @ Manjunath Muttin S/o Ramachandra, aged about 35 years, residing at No. 230, Asare apartment, Near GKW Layout park, premed 2nd stage, Bengaluru 560 060, do hereby solemnly affirm and state on oath as follows:- 1. First of us are the Petitioners and the second of us are the Respondent No.2 in the above case. We know the facts of the case and hence, we are swearing to this affidavit. 2. We submit that due to a misunderstanding and sudden quarrel on 30.05.2025, complaints came to be lodged by both parties against each other, resulting in registration of Crime No.200/2025 by Rajagopalnagar Police Station, Bengaluru, and Crime No.189/2025 (counter case) by the same police station. 3. We submit that the disputes between us were purely personal in nature and arose out of a trivial issue, without any premeditation. 4. We further submit that with the intervention of elders, well-wishers and family members, we have amicably settled the dispute out of Court, and we are now living peacefully without any grievance against each other. 5. We submit that we have no objection for Quashing of FIR in Crime No.200/2025, and Quashing of FIR in Crime No.189/2025 (counter case) pending on the file of Rajagopalnagar Police Station, Bengaluru. 6. We state that continuation of the criminal proceedings would serve no purpose and would only result in unnecessary hardship to both parties. - 7 - HC-KAR NC: 2026:KHC:21781 WP No. 24248 of 2025 C/W CRL.P No. 7786 of 2025 7. We further submit that this Hon'ble Court may kindly exercise its inherent powers under Section 482 Cr.P.C. / Section 528 of B.N.S.S. (as applicable) and permit the parties to compound the matter and quash both FIRs in the interest of justice and equity. 8. We submit that this affidavit is executed voluntarily, without any force, coercion or undue influence from any person. WHEREFORE, we pray that this Hon'ble Court may kindly be pleased to quash the impugned FIR filed in Crime No.200/2025 and Crime 189/2025 (Counter case) registered by Rajagopalnagar Police station, Bengaluru and pass such other relief as deems fit by this Hon'ble Court in the facts and circumstances of the case, in the interest of justice and equity.” 4. The parties to the lis are present before the Court and are identified by their respective counsel. 5. In the light of the Joint Affidavit being filed and offences not being against the State, I deem it appropriate to accept the same and terminate the proceedings against these petitioners in the subject petitions. 6.
