JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner – husband is before this Court calling in question proceedings in C.C.No.8365/2023, pending before the XXXVII Additional Chief Metropolitan Magistrate, Bengaluru, for the offences punishable under Sections 498A and 504 of the IPC and Section 4 of the Dowry Prohibition Act, 1961. 2. Learned counsel for the petitioner and respondent No.2 in unison submit that the parties to the lis were before the family court in M.C.No.6922/2025 and have settled their matrimonial dispute amicably by drawing up certain terms and - 3 - HC-KAR NC: 2026:KHC:13421 CRL.P No. 9295 of 2023 conditions before the mediation center. The parties have partied their ways. They are before this Court seeking permission to compound the offences. The parties have filed a memo, an affidavit and the order sheet of the family court before this Court to that effect. 3. The application reads as follows: “3. I submit that, due to irretrievable breakdown of marriage, the petitioner and I have decided to end this marriage by obtaining a Divorce. The Divorce Petition M.C.No.6922/2025 filed by the Petitioner herein was referred to mediation. 4. I submit that, it was agreed between me and the Petitioner that, we shall withdraw all the pending litigation filed against each other in various Courts. The Petitioner shall pay me a sum of Rs.21,00,000/- (Rupees Twenty One lakhs Only) towards alimony and maintenance. 5. I submit that, the Hon'ble Principal Family Court allowed the Petition by granting Divorce on the terms of settlement arrived before the Mediation and the Petitioner as per the terms of the Settlement Agreement paid me a sum of Rs.21,00,000/- (Rupees Twenty One lakhs Only) by way of two Demand Drafts bearing Nos. 500047 and 500048 drawn on ICICI Bank, Bengaluru. Both the Demand Drafts were presented by me before - 4 - HC-KAR NC: 2026:KHC:13421 CRL.P No. 9295 of 2023 my Bank for encashment and by way of encashment I acknowledge the receipt of the entire amount. 6. I submit that, I had lodged a Complaint against the Petitioner vide C.C.No.8365/2023 filed for offences punishable under Sec 498A and 504 of the Indian Penal Code and Sec 4 of the Dowry Prohibition Act 1961 pending on the file of the Hon'ble XXXVII Additional Chief Metropolitan Magistrate at Bangalore. The Petitioner challenging the said complaint had filed the above Petition for quashing. 7. I submit that, in view of the compromise and settlement arrived between the Parties, the pendency of the Complaint will not serve any purpose and hence, this Hon'ble Court may be pleased to allow the above Petition by quashing the Complaint.” In the light of the fact that the parties have arrived at settlement and since it is a marital dispute, I deem it appropriate to accept the affidavit and terminate the proceedings against the petitioner, as the allegations are not against the State. 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. - 5 - HC-KAR NC: 2026:KHC:13421 CRL.P No. 9295 of 2023 (ii) The proceedings in C.C.No.8365/2023, pending before the XXXVII Additional Chief Metropolitan Magistrate, Bengaluru, stand quashed.
