01. 1. All the ABLAPLs are taken up together and disposed of by the following common order. 2. Instant petitions have been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Padampur P.S. Case No.231 of 2025 corresponding to
Special G.R. Case No.41 of 2025 pending in the court of learned Additional Sessions Judge, Padampur on the grounds stated therein. 3. It is informed to the Court that one of the petitioners, namely, Gobinda Nag, who is working as Peon in a local college does not have any antecedent. But it is informed that the other accused, namely, Sibashankar Nag is having antecedents. The case diary produced by learned counsel for the State with the antecedent report, wherein, it is mentioned that the accused, namely, Sibashankar Nag is having three more criminal cases. The Court finds the accused, namely, Binod Saha @Binod Kumar Saha being similarly situated like Sibashankar Nag having antecedents of similar nature. Mr. Tripathy, learned counsel submits that the said accused has been implicated in three other cases despite not being involved. In so far as the present case is concerned, the recovery has been made from four other accused persons named therein and not from the petitioners. The recovery and seizure relate to cough syrup bottles good in number. In view of the above facts as one of the petitioners is having antecedents and the other one has three cases only and the co-accused, namely, Kalu @ Mukesh Agrawal @Manoj Agrawal, who approached this Court in ABLAPL No. 10927 of 2025 disposed it of on 24th September, 2025 is having around nine cases, this Court is inclined to direct all of them to surrender before the learned court below for being released with stringent conditions instead of accepting their plea for pre-arrest bail. 4.
