Impugned in this petition is an order dated 02.06.2025 passed by the Central Administrative Tribunal, Jammu Bench, Jammu [“the Tribunal”] in TA No. 316/2020 titled “Abdul Qayoom Khan Vs. UT of J&K and others”, whereby the petition filed by the respondent No. 1 herein has been disposed of by directing the petitioners herein to consider the case of the respondent No. 1 for promotion to the post of Field Assistant, keeping in view his improved qualification and the rules under which Javed Ahmed and Zakar Hussain, who too, were middle pass, were promoted. 2. The petition seems to have been filed on the misconception that there is a mandamus issued by the Tribunal to necessarily promote the respondent No. 1 on the analogy of Javed Ahmed and Zakar Hussain. The operative portion of the judgment, which is contained in para No. 09, is clear and unequivocal. A direction has been issued to the petitioners to consider the case of the respondent No. 1 for promotion to the post of Field Assistant WP(C) No. 270/2026 by taking note of the rules under which Javed Ahmed and Zakar Hussain, who too, were middle pass, were promoted as Field Assistants. 3. This needs no clarification that while taking note of the improved qualification of the respondent No. 1, i.e., Matriculation, the petitioners are well within their rights to get the qualification verified in accordance with law. 4. With the aforesaid observations, this petition is disposed of and the order of the Tribunal with the clarification aforesaid, is upheld.
