04/ 05.01.2026: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Balumath P.S. Case No. 22 of 2023, registered under sections 379 and 414 of I.P.C., 30(ii) of Coal Mines Act, Section 21 of MMDR Act and Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rules, 2017 pending in the Court of learned Chief Judicial Magistrate, Latehar.

Learned counsel for the petitioner submits that earlier the petitioner moved in A.B.A. No.6423 of 2023 which has been rejected by order dated 01.09.2023 however observation has been made to surrender before the learned court within two weeks. He further submits that on the fresh ground second anticipatory bail application has been filed.

Learned counsel for the State opposes the prayer and submits that petitioner has criminal antecedent and in view of that earlier anticipatory bail application of the petitioner has been rejected by the Co-ordinate Bench of this Court.

At this stage, learned counsel for the State seeks permission to withdraw this anticipatory bail application with liberty to comply observation of the Co-ordinate Bench made in A.B.A. No. 6423 of 2023.

Accordingly, this anticipatory bail application is dismissed as withdrawn with the aforesaid liberty.
