1. Heard Mr. G. Uddin, learned counsel for the petitioner namely Sujata Basumata, who has filed this application under Section 482 BNSS, 2023 as she is apprehending arrest in connection with CID P.S. Case No.18/2015 under Sections 120(B)/387/420 IPC read with Section 66(D)/67 IT Act. 2. Heard Mr. B. Sarma, learned Additional Public Prosecutor appearing for the State respondent. 3. It is submitted on behalf of the petitioner that she is not involved in connection with this case. Page No.# 2/3 The petitioner has also prayed for anticipatory bail on the ground of parity as a co-accused namely Ms. Drushila Basumata has been granted anticipatory bail in connection with this case. 4. It is submitted that the petitioner is willing to cooperate with the investigation. 5. The learned Additional Public Prosecutor has raised objection stating that there are incriminating materials in the case diary against the petitioner. 6. Money has been transferred to the account of her husband, which has been procured by blackmailing the informant ‘X’. 7. It is also submitted that there are incriminating materials in the case diary against the petitioner and she is not entitled to anticipatory bail considering the nature of the offence. 8. The informant was pushed to the point of committing suicide, but fortunately the informant did not commit suicide. Thus the petitioner is not entitled to anticipatory bail. 9. I have considered the submissions at the Bar with circumspection. The investigation has been continuing since 2015. I have scrutinized the case diary and also considered the progress of the investigation. It appears that custodial interrogation of the petitioner may not be required. The petitioner has pledged to cooperate with the investigation and to abide by any stringent conditions of bail, if imposed upon her. 10. It appears that anticipatory bail will be granted to the petitioner Sujata Basumata. Accordingly, the prayer for anticipatory bail of the petitioner is allowed. 11.
In the event of arrest, the petitioner shall be enlarged on bail on furnishing bail bond of Rs.50,000/- with a local surety of the like amount to the satisfaction of the Arresting Authority subject to the following conditions:- (i) the petitioner shall appear before the I/O within 10 (ten) days and cooperate with the investigation. (ii) the petitioner shall refrain from such activities with which she alleged; (iii)The petitioner shall not hamper with the evidence and appear before the I/O as and when call for. On breach of any of the bail conditions, the anticipatory bail order shall automatically stands cancelled. Page No.# 3/3 Send back the case diary. JUDGE Comparing Assistant
