By way of this application, the applicant is seeking bail in connection with Crime No.812 of 2026 registered with Chandrapur City Police Station, District Chandrapur for the offences punishable under Sections 316(2), 318(4) of the Bharatiya Nyaya Sanhita (BNS), 2023 . During investigation, Section 3(2) of the Maharashtra Prevention and Eradication of Human Sacrifice, other Inhuman, Evil and Aghori Practices and Black Magic Act, 2013 came to be added.
3. The FIR came to be lodged alleging that one Vidya Nimje under the pretext of curing the informant’s husband and improving her household conditions, allegedly duped her for total amount of Rs.25,90,000/-.

Learned Counsel for the applicant submits that accused no. 2 disclosed that she has given an amount of Rs.6 lakhs to the applicant. Apart from that there are no allegations and even in the FIR, name of the applicant does not appear. The FIR was simplicitor registered
2 25.ba.1071.2026 alleging that accused no.1 has extracted the amount from the informant and not the applicant and therefore, as there is no material against the applicant except for the statement of accused no.2, therefore, the applicant prayed to be enlarged on bail. 5. On the other hand, learned APP vehemently opposed the application on the ground that it is a case of cheating as well as black magic. He submitted that amount of Rs.25,90,000/- was given by the informant to accused no.1, out of which as stated by the learned APP, Rs.15 lakhs were given to accused no. 2 and out of this amount Rs.6 lakhs was given to the applicant. He submits that as the investigation is going on, the application is prayed to be rejected. 6. I have considered the rival submissions and perused the record. Perusal of the FIR shows that there is no name of the applicant and even no sufficient material against the applicant except the statement of co-accused to connect the applicant with the alleged crime, hence considering all these aspects, I am inclined to enlarge the applicant on bail. Hence the following order : (a) The application is allowed. (b) The applicant Shabnam Mobin Khan in connection with Crime No.812 of 2026 registered with Chandrapur City Police Station, District Chandrapur for the offences punishable under Sections 316(2), 318(4) of the Bharatiya Nyaya Sanhita (BNS), 2023 and Section 3(2) of the Maharashtra Prevention and Eradication of Human Sacrifice, other
3 25.ba.1071.2026 Inhuman, Evil and Aghori Practices and Black Magic Act, 2013 be released on bail on furnishing P.R. bond of Rs.50,000/- with one or two sureties in the like amount. (c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence. (d) The accused shall provide her residential address and cell number to Police Station concerned and shall not change her place of residence without prior intimation to the Investigating Agency. (e) The accused shall attend each and every date of trial regularly.
If she fails to attend the trial for even a single date, or fails to comply with the aforesaid conditions, her default would entail the State to ask for cancellation of bail. 7. The observations are prima facie in nature and the Trial Court shall not be influenced by the same . 8. All Misc. application(s), pending if any, shall stands disposed of accordingly. (M.M. NERLIKAR
