The petitioner is apprehending his arrest in connection with Dhanwar P.S. Case No. 258 of 2025, registered for the offence under Sections 338/336(3)/340(2)/271/272/274/275/318(4)/3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 47(a) of Jharkhand Excise Act, pending in the court of learned Judicial Magistrate, 1st Class, Giridih. 3. Learned counsel appearing for the petitioner submits that the name of the petitioner has come on the basis of confessional statement. He next submits that foreign liquor has been recovered from the house of one Choti Gosai. He further submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-6 of the petition. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the name of the petitioner has come on the basis of confessional statement. 5. Considering that the name of the petitioner has come on the basis of confessional statement and further the petitioner is having no [2026:JHHC:11075] -2- criminal antecedent and disclosure to that effect has been made in para- 6 of the petition, in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
