This writ appeal has been filed against the common order of the learned Single Judge dated 17.07.2026 in W.P.(MD)Nos.20505 & 20506 of 2026. 2.Both the writ petitions have been filed by two separate police personnel in the nature of Certiorari to quash orders dated 15.07.2026 by which orders, the two writ petitioners were directed to be transferred from one place to another place. It has to be noted that initially a complaint was lodged before the Saminathapuram Police Station at Dindigul on 08.05.2026 by one Sethuraman, wherein he had stated that when his younger brother Shivaharish was walking in the road, a Tractor Trailer bearing registration No.TN-57-1990, which was driven in a rash and negligent manner, came and dashed against him/ Shivaharish, who died on the spot. 3.Subsequent to enquiries, on the basis of the visuals in CCTV camera, further details came to be known that the said tractor trailer was driven by one Natarajan. A complaint was lodged, on the basis of which FIR in Crime No.990 of 2026 had been registered for the offences punishable under sections 281 and 105 (1) of BNS, 2023. WA(MD) No. 1245 of 2026 __________ Page3 of 6 the said tractor trailer was actually driven by a relative of the writ petitioner in W.P.(MD)No.20505 of 2026, who incidentally happened to be a Police Head Constable. The other petitioner, who is the appellant herein, in W.P. (MD)No.20506 of 2026 was the Special Superintendent of Police, both were working in Swaminathapuram Police Station.
4.Enquiry was initiated by the higher officials against both the writ petitioners on the ground that they had opened up negotiations with the accused /Driver of the tractor-tailor and a bribe amount of Rs.1,00,000/- was determined. Out of the said Rs.1,00,000/-, the driver of the tractor-trailer had paid a sum of Rs.30,000/- to the victim’s family and another sum of Rs.10,000/- for the ambulance and a sum of Rs.10,000/- to the appellant and the other Police Woman Head Constable, namely Sudharani. The appellant specifically received a sum of Rs.4,000/- on 08.05.2026 from one of the relatives of the Woman Head Constable, Sudharani. On the basis of these allegations, both the writ appellant and the other Woman Head Constable, Sudharani were transferred out of Swaminathapuram Police Station, Dindigul to Madurai. 5.This order was put in challenge in the writ petitions. Prima facie, the writ petitions were not maintainable. The appellant, being a member of the Uniformed Service, must work at any place he is authorised and directed to work. However, the learned Single Judge had been extremely sympathetic and had modified the order of transfer and had put herself in the position of the Transferring Authority and had directed that the writ appellant should be transferred to Madurai and the said Sudharani to Vedasandur within Dindigul District. That order does not withstand our scrutiny. 6.The learned counsel for the writ appellant stated that the orders of transfer were both visited with mala fide. We do not agree that there is any malice in the said transfer.
They were on the basis of specific information received that from the accused a sum of Rs.1,00,000/- had been received and out of which, a sum of Rs.30,000/- had been paid to the family of the victim another sum was apportioned towards the ambulance and the balance had been shared between the appellant and the other woman Head Constable. This conduct of receiving tainted money and pocketing tainted money can never be appreciated or condoned by us. Even the authorities have been extremely liberal in only directing transfer of the individuals. The writ petitions themselves are not maintainable. The order of the learned Single Judge granting more benefit is set aside. https://www.mhc.tn.gov.in/judis
