1. Instant petition has been filed under Section 528 BNSS assailing the order dated 22.12.2025 passed by learned Additional Chief Judicial Magistrate, Nadbai, District Bharatpur whereby the application filed by the petitioner under Section 72(2) BNSS for converting the warrant of arrest into bailable warrant has been dismissed.

Learned counsel for the petitioner submits that vide order dated 04.02.2021, cognizance for the offence under Section 138 of Negotiable Instruments Act (in short, "N.I. Act") was taken by learned trial Magistrate and issued process against the petitioner. It is submitted that vide order dated 14.11.2025, warrant of arrest was issued by learned trial Court to ensure the presence of the petitioner. It is submitted that in these circumstances, an application was filed by the petitioner under Section 72(2) BNSS
[2026:RJ-JP:10571] (2 of 2) [CRLMP-383/2026] for converting the arrest warrant into bailable warrant. Learned counsel contends that petitioner is lady and alleged offence punishable under Section 138 of N.I. Act is bailable in nature. It is contended that petitioner is ready to face the trial.

Considering the aforesaid facts and circumstances of the case and further considering the fact that petitioner is ready to face the trial, I deem it just and proper to dispose of this criminal misc. petition with the direction to the petitioner to appear before learned trial Court on or before 30.03.2026 and submit her bail bonds to the satisfaction of the learned trial Court. Upon furnishing bail bonds, learned trial Court shall accept the same.
4. With the aforesaid directions, this Criminal Misc. Petition is
disposed of.
5. If the petitioner fails to submit her bail bonds within stipulated time, this order shall lose its efficacy.
