ORDER : The Court made the following order :- The petitioners / accused 1 to 3, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 115(2), 140(2), 296(b) and 308(2) BNS, in Crime No.309 of 2026 on the file of the respondent police, seek anticipatory bail. 2. The case of the prosecution is that there existed property dispute between the defacto complainant and the petitioners 1 and 2 and that on 19.07.2026 at about 04.30 p.m., when the defacto complainant was sitting near Kakayampatti Union school, the petitioners and the other accused abducted the defacto complainant in a car and abused him in filthy language and attacked him and also obtained signature in a blank bond paper. The learned counsel appearing for the petitioners would submit that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. He would further submit that due to the civil dispute, the petitioners have been falsely implicated in this case, that there is no such occurrence as stated by the defacto complainant and that the accused 4 and 5 were already arrested and released on bail. 4. The learned Counsel for State of TN (Criminal Side) appearing for the respondent police would submit that there existed property dispute between the parties and that the petitioners along with other accused had abducted the defacto complainant and attacked him with wooden log. 5.
