For Respondent : Mr.N.Balasubramanian, Counsel for State of TN (Crl.Side) ORDER : The Court made the following order :- The petitioners/A1 and A2, who were arrested and remanded to judicial custody on 19.07.2026 for the offences punishable under Sections 1/6 CRL OP(MD). No.17156 of 2026 326(g), 296(b), 351(3) and 288 of BNS, 2023, in Crime No.216 of 2026, on the file of the respondent police, seek bail. 2. The case of the prosecution is that A1 fell in love with the daughter of the defacto complainant, which was objected by the defacto complainant's family. Due to which, the petitioners threw a petrol bomb at the house of the defacto complainant. Hence, the case has been registered and the petitioners were arrested on 19.07.2026. 3.The learned counsel appearing for the petitioners would submit that the petitioners are innocent and they have been falsely implicated in this case. He would further submit that no one sustained any injury in the alleged occurrence and that no damage was caused to any other property and the petitioners have no bad antecedents. Hence, he prayed to grant bail to the petitioners. 4.The learned Counsel for State of TN (Crl. Side) appearing for the respondent police would submit that though the petitioners have no bad antecedents, the offence committed by the petitioners is grave in nature. Hence, he opposed to grant bail to the petitioners. 2/6 CRL OP(MD). No.17156 of 2026 5.Considering the above and also the nature of the charges levelled against the petitioners and that the petitioners are not having any bad antecedents and also considering the incarceration undergone by the petitioners, this Court is inclined to grant bail to the petitioners with certain conditions. [a] Accordingly, the petitioner are ordered to be released on bail on condition to execute a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) each with two sureties each for a like sum to the satisfaction of the Judicial Magistrate Court No.II, Virudhunagar, Virudhunagar District, and on further conditions that: [b] the petitioners shall report before the respondent police daily at 10.30 a.m., for a period of 30 days and thereafter as and when required for interrogation. [c] the petitioners shall not commit any offence similar to the offence of which he is accused, or suspected, or of the commission of which he is suspected; [d] the petitioners shall not abscond either during investigation or trial; [e] the petitioners shall not directly or indirectly make 3/6 CRL OP(MD). No.17156 of 2026 any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the Court or to any police officer or tamper with the evidence; [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
