ORDER : The Court made the following order :- The petitioner / second accused, who was arrested and remanded to judicial custody on 18.07.2026 for the offences punishable under Sections 126(2), 296(b), 308(5), 351(3) BNS r/w Section 25(1A) of Arms Act, in Crime No.593 of 2026, on the file of the respondent police, seeks bail. 2. The case of the prosecution is that due to previous enmity, on 18.07.2026, the petitioner along with other accused armed with aruval and wooden log, trespassed into the house of the defacto complainant and abused him in filthy language and assaulted him and also threatened him with dire consequences and robbed a sum of Rs.500/- from him. Hence, the complaint. 3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in the above case and that he is no way connected with the alleged crime. CRL OP(MD). No.17387 of 2026 accused Suman was granted bail by this Court in Crl.O.P.(MD)No.16480 of 2026 on 06.08.2026. 4. The learned Counsel for State of TN (Criminal Side) appearing for the respondent police would submit that there are totally three accused and that the accused persons extracted money from the defacto complainant. He would further submit that the petitioner is having two previous cases one case for the offence under Section 302 IPC and another case for the offence under Section 324 IPC. 5. Considering the above facts and circumstances and also the facts that the petitioner is in judicial custody from 18.07.2026 and that the petitioner is not having any previous cases for similar offence, this Court is inclined to grant bail to the petitioner subject to the following conditions:
6. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with 3/6 https://www.mhc.tn.gov.in/judis

(i)the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate / concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; (ii)the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders; (iii)the petitioner shall not tamper with evidence or witness; (iv)the petitioner shall not abscond during trial; (v)On breach of any of the aforesaid conditions, the learned Magistrate / Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate / Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]; 4/6 https://www.mhc.tn.gov.in/judis
