CRL OP(MD). No.16317 of 2026 PRAYER :- For Anticipatory Bail in Crime No.38 of 2026 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioners / accused 1 to 3, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 76 and 115(2) BNS r/w Sections 7 and 8 of POCSO Act, in Crime No.38 of 2026 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that there existed pathway dispute between the family of the victim girl and the accused persons, due to which, on 26.07.2026, there was a wordy altercation between them and at that time, the petitioners wrongfully restrained the victim girl and assaulted her and pulled the leggings worn by her and also touched her private part. Hence, the complaint.
3. The learned counsel appearing for the petitioners would submit that the petitioners are 2/6 https://www.mhc.tn.gov.in/judis
CRL OP(MD). No.16317 of 2026 innocent and they have not committed any offence as alleged by the prosecution. He would further submit that there existed pathway dispute between the parties and two FIRs came to be registered against both the parties, that with the help of the victim girl, they have foisted the false case and that the alleged occurrence is false.

The learned Counsel for State of TN (Criminal Side) appearing for the respondent police would submit that the petitioners misbehaved with the victim girl, who is aged 16 years and he has produced the copy of the 183 B.N.S.S. statement recorded from the victim girl, wherein, she has given a statement reiterating the FIR contentions and has specifically implicated the petitioners and also stated about the alleged threatening made by them.
5. Considering the seriousness and gravity of the offence alleged as against the petitioners, this Court is not inclined to grant anticipatory bail to 3/6 https://www.mhc.tn.gov.in/judis

6. In the result, this Criminal Original Petition is dismissed.
