This is an application for deleting the names of respondent Nos.2 to 8 from the writ petition as they are not necessary parties and the matter is compromised between the petitioner and respondent No.1. 2. The respondent No.5(e) has raised an objection for deletion as she is having undivided share in the suit property. The learned Counsel for the respondent No.5(e) has stated that one second appeal out of same judgment is pending before this Court between the same parties. As the compromise took place between the petitioner and respondent No.1 and another second appeal is pending out of same judgment, if the respondent No.5(e) succeeds in said appeal i.e. Second Appeal No.44/2022, the petitioner has no objection to claim any portion of the suit property out of this compromise deed and map by the respondent No.5(e) as 2026:BHC-NAG:11174 2 ca2118.2026 according to learned Counsel for the petitioner this compromise deed and map is not binding on the respondent No.5(e). In view of above, and as the respondent Nos.2 to 8, except respondent No.5(e), are having no objection to delete the names of respondent Nos.2 to 8, the application is allowed and disposed of. The names of respondent Nos.2 to 8 are deleted. CIVIL APPLICATION (CAW) NO.2119/2026. 3. The application is filed for recording compromise between the consenting parties. The parties are present before the Court. They have no objection for the compromise and they agreed to distribute the property as per the terms and conditions of the compromise deed. The civil application is allowed and disposed of. In view of this, the petition stands disposed of in term of compromise deed. A Compromise decree be drawn up accordingly. 4.
