For Petitioner : Mr.M.Venkatesan For Respondents : Mr.V.Sasi Kumar SPCGC 1/5 https://www.mhc.tn.gov.in/judis WP(MD)No.9556 of 2026 ORDER The petitioner while serving in the Railway Protection Force, Ponmalai, Trichy was promoted as Sub Inspector of Police and posted at Viluppuram on 29.11.2021 and he was relived from Ponmalai on 30.11.2021. Since the petitioner's children were studying in Kendriya Vidyalaya school, Ponmalai, Trichy and the petitioner was unable to get admission at Villupuram as it was in the middle of the academic year, the petitioner submitted a representation to the 1st respondent to permit him to retain the quarters at Ponmalai, but the same was not considered. Instead they have deducted damage rent from the petitioner vide proceedings dated 06.11.2023. As against the same, the petitioner has filed a writ petition before this court in WP(MD)No.8632 of 2024 and the same was disposed of by this court by order dated 05.04.2024 with a direction to the 1st respondent to deduct the damage rent after providing an opportunity to the petitioner by issuing show cause notice to him. Based on this order of the court, this writ petition has been filed by the petitioner seeking a direction to the respondents not to deduct the damage rent from the petitioner's salary without issuing any show cause notice or without conducting any enquiry as directed by this court in 2/5 https://www.mhc.tn.gov.in/judis WP(MD)No.9556 of 2026 WP(MD)No.8632 of 2024 vide order dated 05.04.2024. 2.The learned Standing Counsel appearing for the respondents submits that as directed by this court in WP(MD)No.8632 of 2024, they have issued show cause notice to the petitioner on 25.05.2025, for which the petitioner has submitted his explanation on 27.05.2025. Thereafter the order has been passed on 07.06.2025. The copy of the order has also been furnished to the petitioner. 3.In reply, the learned counsel for the petitioner submits that the order of this court dated 05.04.2024 has not been complied with and the principle of natural justice has not been followed. The respondent has not furnished the said order dated 07.06.2025 to the petitioner till date. 4.This court has considered the rival submissions made. 5.The petitioner has overstayed in the quarters at Trichy after his transfer on 30.11.2021. The 1st respondent has deducted damage rent. In the earlier round of litigation, this court by its order dated 05.04.2024 3/5 https://www.mhc.tn.gov.in/judis WP(MD)No.9556 of 2026 directed the 1st respondent to provide the petitioner an opportunity of hearing before passing the order for deducting the damage rent. It appears pursuant to the orders of this court, show cause notice was issued to the petitioner, explanation was obtained from him and orders were passed. If the petitioner is aggrieved by the orders of the 1st respondent, it is open to him to challenge the same in the manner known to law. 6.With the above observation, this writ petition is closed.
