Mr. Shailendra Singh Chauhan, Advocate for respondent no. 2. 4. Petitioner was engaged on contract as Junior Engineer in Uttarakhand Rural Roads Development Agency, in the year 2014. By means of this writ petition, he has sought the following reliefs:- “(i) Issue a writ, order, or direction in the nature of Mandamus commanding the Respondent authorities to formally accept the resignation tendered by the Petitioner on 15.11.2023 (Annexure No. 6; Page nos. 69- 72)prospectively (without any retrospective penal effect); (ii) Issue a writ, order or direction in the nature of Mandamus commanding the Respondents to forthwith issue a valid Experience and Relieving Certificate to the Petitioner, reflecting his continuous service from 24.02.2014, to enable him to seek fresh employment; (iii) Issue a writ, order, or direction in the nature of Mandamus commanding the Respondents to immediately release and pay the entirety of the pending salary from November 16, 2023 onwards and to pay arrears, and terminal dues owed to the Petitioner up to the effective date of his resignation, along with exemplary penal interest at the rate of 12% per annum for the delayed period.” 2026:UHC:4379 5. Learned counsel for the petitioner submits that petitioner tendered resignation on 15.11.2023, which has not been accepted so far. He submits that although tax is being deducted at source on the amount payable as wages to the petitioner, however, wages are not being paid to him since December, 2023. It is further contended that the Department is not issuing NOC, due to which petitioner is not able to apply for appointment elsewhere. 6. Learned counsel for the respondents submits that petitioner can approach the competent authority, by making representation and representation, if made, within two weeks, shall be decided as early as possible. 7. The writ petition is, accordingly, disposed of by permitting petitioner to make representation. If he makes representation within two weeks, Competent Authority in Uttarakhand Rural Roads Development Agency shall take decision thereupon, as per law, within six weeks thereafter.
