Order 17/04/2026
1. Apprehending his arrest in connection with FIR No.102/2025 registered at Police Station-Chiksana, District-Bharatpur for the offences under Section 13 of RPGO Act and Section 112(2) of BNS, 2023, the petitioner has preferred this bail application under Section 482 BNSS.
2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He contends that initially the petitioner was alleged to have committed bailable offences and only to give gravity to the case the police has added non-bailable offences in the present matter. It is further submitted that in compliance with the order dated 03.02.2026, the petitioner has joined the investigation and is co-operating in the investigation.
[2026:RJ-JP:16193] (2 of 2) [CRLMB-11132/2025] No custodial interrogation is required and petitioner is ready to join and co-operate with the investigation. Hence, the anticipatory bail of the petitioner may be allowed.
4. Learned Public Prosecutor along with Investigating Officer present in Court has vehemently opposed the bail application and submits that no custodial interrogation is required.
5. Considering the nature of allegations and the fact that the petitioner is ready and willing to co-operate with the investigation of the case but without commenting anything on the merits/demerits of the case, I deem it just and proper to allow the bail application of the petitioner.
6. Accordingly, the bail application under Section 482 BNSS is allowed and it is ordered that in the event of arrest of the petitioner-Harvendra S/o Peetam, he shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioner shall make himself available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and (iii) that the petitioner shall not leave India without previous permission of the court.
