Respondent in H.M.O.P.No.16 of 2026 on the file of Civil Judge (Senior Division), Kadiri, Sri Satyasai District, is the wife and petitioner herein, filed the present application with a prayer for withdrawal and transfer of the said matter to the Court of Principal Civil Judge (Senior Division), Madanapalli, Chittoor District, for trial and disposal along with H.M.O.P.No.49 of 2023 initiated by the petitioner herein. 2. Petitioner - wife filed case in H.M.O.P.No.49 of 2023 before the Principal Civil Judge (Senior Division), Madanapalle, Chittoor District, for dissolution of marriage and grant of divorce in the year 2023. Respondent – Husband has filed the case vide H.M.O.P.No.16 of 2026 for restitution of conjugal rights, now sought to be transferred. 3. Learned counsel for Petitioner would submit that the petitioner has been residing at Madanapalli with her parents and depending on her parents. He would also submit that the respondent actually appearing before the Court at Madanapalli. Wife is seeking transfer of the case on the grounds of - pendency of connected matter and her stay at Madanapalli and inconvenience of her on physical and financial constraints for travelling from Madanapalli to Kadati to attend before the Court, as she is depending upon her parents. 3 AHHS,J Tr.C.M.P.No. 110 of 2026 4. Learned Counsel for respondent – husband opposed stating that it will be difficult for the respondent – husband to travel from Kadiri to Madanapalli for attending the case and the case is filed by the husband for restitution of conjugal rights. 5. Points submitted on behalf of the petitioner-wife: – i. Firstly, the wife has initiated legal proceedings in the year 2023; ii. Wife is residing at Madanapalli. iii. Husband has entered appearance and pursuing the case at Madanapalli. iv. Respondent-husband has not taken any steps seeking transfer of case from Madanapalli to Kadiri. v. The petitioner is woman, is suffering physical and financial difficulties for travelling from Madanapalli to Kadiri, which is around 90 K.Ms. 6. Upon considering the reasons/grounds stated above the prayer in the petition is found convincing and the petition is allowed, as follows:- i. H.M.O.P.No.16 of 2026 on the file of Civil Judge (Senior Division), Kadiri, Sri Satyasai District, is withdrawn and transferred to the Court of Principal Civil Judge (Senior Division) at Madanapalli, Chittoor District, for trial and disposal, according to law. ii. The learned Civil Judge (Senior Division), Kidiri, is directed to transfer the record forth-with, after duly indexed. iii. Learned Principal Civil Judge (Senior Division), Madanapalli is directed to dispose of the case as expeditiously as possible, however, without insisting 4 AHHS,J Tr.C.M.P.No. 110 of 2026 the presence of the respondent – husband, unless his presence is specifically required and at the same time, respondent – husband shall also co-operate for speedy disposal, without taking unnecessary adjournments. iv. Both parties are directed to co-operate for speedy disposal of the case by the Principal Civil Judge (Senior Division), Madanapalli. v. Simultaneous and common disposal of both cases is left to the discretion of the Principal Civil Judge (Senior Division), Madanapalli, depending upon the possibilities, considering the stage of the case and other practical difficulties. 7. Accordingly, the Transfer, Civil Miscellaneous Petition is allowed. No costs.
