1. Heard Mr. S. M. Abdullah P, learned counsel for the petitioner. Also heard Mr. M. P. Goswami, learned Additional Public Prosecutor for the State of Assam and Mr. S. Munir, learned counsel for the respondent No.2. 2. This is an application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for quashing of the criminal proceedings in PRC No.1324/2026, pending in the Court of the learned Judicial Magistrate First Class No.4, Kamrup (Metro) at Guwahati. 3. The informant girl was maintaining a relationship with the present petitioner. The petitioner had promised to marry her. It may be mentioned that the petitioner was already married and had a wife. Despite being in a relationship with the informant for a long time, he did not marry her. She has alleged that, on the false promise of marriage, the petitioner established physical relations with her. 4. Today, learned counsel for the respondent No.2, Mr. Munir has submitted that both sides have already settled their disputes and the girl no longer is interested in prosecuting the petitioner. She agrees that criminal proceedings can be quashed. An affidavit sworn by the girl has submitted by Mr. Munir. 5. I have considered the submissions made by the learned counsel for both sides. 6. This Court is of the opinion that, since the petitioner and the informant have
Page No.# 3/3 amicably settled their disputes, there is no possibility of conviction in the case. Therefore, allowing the criminal proceedings to continue before the Trial Court would be against the interests of justice. Accordingly, this criminal petition is allowed. 7. The proceedings of PRC Case No.1324/2026, pending in the Court of the learned Judicial Magistrate First Class No.4, Kamrup (Metro) at Guwahati is quashed and set aside. 8.
With the aforesaid direction, this criminal petition stands disposed of. JUDGE Comparing Assistant
