The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.473/2025, registered at Police Station Nawagarh, District Janjgir Champa (C.G.) for alleged commission of offence punishable under Sections 304(2), 3(5) of B.N.S. 2. Case of the prosecution, in brief, is that on 11/10/2025 the complainant namely Ram Kumar Chandra has lodged report before P.S. Nawagarh against the applicant and other co-accused person stating that when he was going to house at that time the accused person snatched Rs.80,500/- of cash amount from motorcycle, thereafter police has lodged FIR against the accused person for aforesaid offence.

Learned counsel for the applicant submits that the applicant is a juvenile and is aged 17 years and the regular bail of the co-accused who is his uncle namely Keshav Prasad Chandra has already been rejected vide MCRC No.3227/2026 on 09/04/2026. He would submit that the complainant and applicant are relative and due to family dispute, the complainant has falsely implicated the present applicant. He would submit that the other co-accused person namely Keshav Chandra who is uncle of applicant and the dispute was between complainant and his uncle but unnecessarily the complainant has implicated the present applicant in the instant case. He would submit that the applicant has not snatched any amount nor any vehicle has been looted. He would further submit that the applicant is a permanent resident of address mentioned in the cause title and there is no likelihood of absconding, the applicant undertakes to abide by any conditions imposed by this Court, therefore, he submits that the present applicant is entitled for grant of anticipatory bail.
4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail. She would submit that the regular bail of co- accused Keshav Prasad Chandra has already been rejected vide MCRC No.3227/2026 on 09/04/2026.

5. I have heard learned counsel for the parties and perused the materials available on record.
6. Considering the facts & circumstances of the case, submission of
learned counsel for the parties, materials available on record, further the fact that the applicant claims to be a juvenile, but there appears to be no documentary evidence has been filed with the bail application to show that he is a juvenile, the Court fails to understand as to how his name has been mentioned in the bail application which goes to show that he is taking benefit of a juvenile without there being any justification, further the regular bail of his uncle Keshav Prasad Chandra has already been rejected vide MCRC No.3227/2026 on 09/04/2026, therefore I am not inclined to grant anticipatory bail to the applicant.

Accordingly, the anticipatory bail application of the applicant - Manish Kumar Chandra, involved in Crime No.473/2025, registered at Police Station Nawagarh, District Janjgir Champa (C.G.) for alleged commission of offence punishable under Sections 304(2), 3(5) of B.N.S. is rejected.
