The instant writ petition has been preferred by the petitioners seeking following reliefs :- "(i) Issue an appropriate writ, order or direction for restraining the Respondents from plotting, auctioning, alienating, or commercially exploiting the land admeasuring 25,000 square metres and which was reserved for R.B.M. Hospital, Bharatpur in Scheme No. 10 of the Bharatpur Development Authority vide order dated 31.12.2021, in any manner whatsoever; and (ii) Issue an appropriate Writ, order or direction to the Respondents to maintain and preserve the additional land falling under Scheme No. 10 admeasuring 25,000 square metres and adjacent to R.B.M. Hospital and allot the same to R.B.M. Hospital, Bharatpur for establishment of Radiotherapy Centre, Trauma Centre, Super Speciality Centre and Nursing College,; and (iii) Issue an appropriate writ, order or direction to the Respondents to cancel and/or recall any alienation, sale allotment or auction of any part of land kept reserved or proposed to be kept reserved for RBM hospital by the Bharatpur Development Authority under Scheme No. 10; and (iv) Issue an appropriate Writ, order or direction to the Respondents to take immediate steps for allotment and utilization of the reserved land admeasuring 25,000 square meters and additional vacant land admeasuring 25,000 falling in Scheme No. 10, Bharatpur for expansion of RBM Hospital in accordance with law, policy decisions, and budgetary announcements; (v) Issue any other order, direction, declaration which Your Lordships deem just fit and proper in the facts and circumstances of the case in favour of the petitioner;" 2. At the threshold, Mr. G.S. Gill, learned Additional Advocate General assisted by Ms. Shikha Sharma appearing the respondents-State has shown this Court a factual report dated [2026:RJ-JP:13732-DB] (3 of 3) [CW-4594/2026] 01.04.2026, which according to him is sufficient to dispose of the present writ petition (PIL). 2.1 The factual report dated 01.04.2026 is taken on record and reproduced hereunder :- " भरतपुर विकास ्ቚाविकरण , भरतपुर त्ቔा्ቒक रिरपो्቏ ( योजना सं्ቅा 10) योजना सं्ቅा 10 का रा्ቋ सरकार ्ቛारा विनांक 10-11-2009 को अा्ቑ अनुमोन विकया गया  ्቗ास ्ቛारा क्ቈा विनांक 18-12-2013 को ्ቚा्቎ विकया गया। उ्ሹ योजना एक ्ቤासावियक योजना है एं भरतपुर मा्቗र ्ቜान 2023 के अनुसार ्ቤसावियक ्ቌे्ቔ में वि0त है। ्቗ास की ्቏्र्቗ बैठक विनांक 14-06-2021 में योजना सं्ቅा 10 में आर.बी.एम. अ्ቢताल हेतु लगभग 25000 गमी्቏र भूविम ्቏्रोमा से्ቇर एं अ्቗ मेवि्ቑकल वि्ቜार हेतु आरवि्ቌत करने का विनणय विलया गया तथा तानुसार विनांक 21-10-2021 को ले- आउ्቏ सं0ोन विकया गया। उ्ሹ ्ቚ्ቜा पर रा्ቋ सरकार ्ቛारा विनांक 01-06-2022 को ्ቭीकृ वित ्ቚान की गई। योजना का ले आउ्቏ ्ቜान अनुसार ्ቌे्ቔफल 71900 गमी्቏र है। इसके अलाा तमान सरकार ्ቛारा रा्ቖ्र ीय राजमाग से समीपता एं 0हर के ्቏्रैविफक को ेखते हुए मेवि्ቑकल कॉलेज के पीछे एस.पी. जे्ቑ योजना में ्቏्रोमा से्ቇर (यूविन्቏) एं मां एं वि00ु अ्ቢताल (एम.सी.एच) हेतु 19176.68 गमी्቏र भूविम आंवि्቏त की गयी है। योजना में 25000 गमी्቏र का सुविा ्ቌे्ቔ है। भरतपुर विकास ्ቚाविकरण ्ቛारा अ्቗ वि्ቅय यो्ቆ ्ቌे्ቔ में काय कराये जा रहे हैं विजसमे सम्ቜ पा्ቔ  आविनांक तक oafpr खातेारो को यथा0ी्ቈ भूविम के बले भूविम विये जाने की कायाही की जा रही है। ;kstuk और आर-बी- म से स्቏ी भूविम पर रा्ቋ सरकार ्ቛारा अ्ቢताल वि्ቜार ( ा्ቑ  ्቗ाफ हेतु सुविाए), मरीजो  परिरजनो के विलए सुविा, प቞ኌMक पाविकN ग इ्ቓावि जैसी सुविाए हेतु 25000 ग मी्቏र भूविम रिरज रहेगी। त्ቔा्ቒक रिरपो्቏ सार ्ቚ्ቜुत है।" 3. In light of the limited submission made by the learned AAG, the present writ petition (PIL) is disposed of with liberty to the petitioners to file a representation before the respondents, if anything survives and to approach this Court again, in case need arises. 4.
