Learned counsel for the Petitioners would submit that the issue involved in the petition has already been resolved in case of Suraj BHUMIKA ANGARE Digitally signed by BHUMIKA ANGARE Date: 2026.02.05 16:43:54 +0530 2 Sahu Vs. State of Chhattisgarh & Ors. bearing WPS No. 10852 of 2019 and in case of Vidyanand Yadav Vs. State of Chhattisgarh & Ors. bearing WPS No. 10826 of 2019, therefore, the same may be disposed of in terms of order passed in Suraj Sahu (supra). 2. Learned State counsel has also supported the aforesaid submission. 3. I have heard learned counsel for the parties, considered their rival submissions made hereinabove and went through the record with utmost circumspection. 4. This Court in matter of Suraj Sahu (supra) in paragraphs No. 4 & 5 has held as under: “4. Given the aforesaid facts of the case, particularly taking note of the award of the Labour Court dated 01.04.2010 wherein there is a specific relief of reinstatement with continuity of service, the case of the petitioner also requires consideration. 5. Accordingly, the present writ petition stands disposed of with a direction to the respondents to consider the claim of the petitioner in the light of the Circular dated 05.03.2008. While deciding the same, the authority concerned would keep in mind the award of the Labour Court dated 01.04.2010. Let an appropriate decision be taken as early as possible preferably within a period of 4 months from the date of receipt of copy of this order.” 3 5. Accordingly, the instant petition is disposed of in terms of order passed by this Court in case of Suraj Sahu (supra). 6.
