By the present application, the applicant / informant takes exception to the order dated 27/7/2026 passed in Criminal Bail Application No. 2354 of 2026 by the learned Additional Sessions Judge-3, Nagpur, whereby non-applicant Nos. 2 and 3 namely Gaurav Sanjay Sherke and Sanjay Sherke, as well as other accused namely Archana Sanjay Sherke, Dolly Sanjay Sherke and Divya Sanjay Sherke, were released on ad-interim anticipatory bail in connection with Crime No. 467 of 2026 registered with Kanhan Police Station for the offence punishable under Sections 108, 85, 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. The present applicant/informant alleged that, on 26/7/2026, her daughter deceased lost her life on account of mental, physical, emotional and psychological cruelty at the hands of the present non-applicant Nos. 2 and 3 as well as other accused persons, coupled with 2 24apl79.2026.odt threats of circulating certain personal information on social media, i.e. Instagram. 4. After considering the nature of the crime, the allegations as well as the role played by the accused Nos. 1 to 5, namely 1) Gaurav Sanjay Sherke, 2) Sanjay Shyamrao Sherke, 3) Archana Sanjay Sherke, 4) Dolly Sanjay Sherke, and 5) Divya Sanjay Sherke, learned learned Additional Sessions Judge-3, Nagpur, passed an order in Criminal Bail application No. 2350 of 2026 and enlarged all the accused on ad-interim anticipatory bail, subject to certain terms and conditions. 5. The applicant/informant has challenged the said order before this Court on the ground that the FIR discloses a prima-facie case against the non-applicants about continuous physical, mental, emotional and physiological cruelty allegedly inflicted upon her married daughter at the hands of the accused persons, due to which her married daughter committed suicide within a few months of her marriage. It is further contended that the evidence collected in the course of investigation connects the accused persons with the alleged crime. 6. Needless to say that, during the course of argument, learned APP produced copy of order dated 13/8/2026 passed by the Additional sessions Judge-3, Nagpur, in Criminal Bail Application No. 2350 of 2026, thereby confirmed the ad-interim anticipatory bail in respect of accused Nos. 2 to 5, namely Sanjay Shyamrao Sherke, Archana Sanjay Sherke, Dolly Sanjay Sherke, and Divya Shanjay Sherke. However, the anticipatory bail in 3 24apl79.2026.odt respect of accused No.1- Gaurav Sanjay Sherke i.e. non- applicant No.2 needs to be rejected. 7. In view of the subsequent order passed by the learned Additional Sessions Judge-3, Nagpur, whereby the anticipatory bail granted to non-applicant No.2 has been rejected, nothing survives for consideration in the present application.
