The petitioner has filed this petition seeking the following relief(s):- “10.(i) That, this Hon'ble Court may kindly be pleased to direct the respondent to grant leave encashment and arrears of 6th and 7th pay with interest within stipulated time as per circular Annexure P-4, in the interest of justice. 2 (ii) Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.” 2. It is contended that the petitioner was working as Assistant Teacher under Respondent No. 3, Ajuman Urdu Primary School Basna, District Mahasamund, which is a Government-aided school. The petitioner retired from services on 30.06.2020; however, he has not been extended the benefits of arrears of 6th & 7th Pay Commissions and also not paid leave encashment. It is also contended that representations were made before respondent No. 3; however, respondent No. 3 is not the competent authority to decide the claim of the petitioner. 3. Taking into consideration the above discussed facts, at this juncture, the petition is hereby disposed of granting liberty in favour of the petitioner to make a fresh representation before the competent authority and in turn, the competent authority shall consider and decide the same expeditiously, in accordance with law.
