1. By this application, the petitioner is seeking amendment for adding “State Common Inference Test Cell, Maharashtra State and V. M. Vasant Commerce, J. M. Thakar Arts and J. J. Patel Science College, Nagpur” as a necessary party and to add para “3-A”, so also to add prayer clause “(III-a)” in the prayer clause of the petition.
2. In view of the reasons mentioned in the application, amendment application is allowed. Amendment be carried out forthwith.
3. The application is disposed of.
WRIT PETITION NO.4474 OF 2026

On amending the petition, learned counsel Mr. Nikhil Gaikwad waives notice for respondent No.2.
2. The petitioner herein seeks an interim relief to consider his candidature from the Scheduled Tribe category, as 2026:BHC-NAG:11687-DB
(2) 31.wp.4474.2026.odt college has already allotted admission to him. The allotment letter is placed on record, which shows that he was admitted from Scheduled Tribe category, however, his admission would be subject to furnishing the Caste Validity Certificate. His caste claim is already invalidated by the Committee by passing
order dated 31.03.2023. It is submitted by the learned counsel that there are already validity certificates granted in the family i.e. Rameshwar, who is the father and Gaurav is the cousin brother. Thus, he submitted that on the basis of the said validity certificates granted to the nearest relatives of the petitioner, he is having every chance of success in the present petition. However, at this stage, his admission is on the step for want of validity certificate, in view of that, his admission be protected.
3. Learned AGP and learned counsel for the respondent No.2 strongly opposed the said contention and submitted that production of the validity certificate is a pre-condition, which is not produced and hence, the prayer deserves to be rejected.

Considering that there are already validity certificates granted in the family to the nearest relatives i.e. father and cousin brother, on the basis of the pre-constitutional documents, at this stage, the petitioner, who is already allotted a seat and he is likely to be admitted in Master in Computer Science Course, in view of that, the respondent No.2 shall consider his candidature from the Scheduled Tribe category and no coercive action shall be taken against him to cancel his admission by taking any coercive measures.
