05 /19.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 323, 324, 302/34 of the Indian Penal Code.
2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order.

Learned counsel for the petitioner submits that from the statement of two of the witnesses namely, Dewakar Kumar Yadav and Sangeeta Devi, it is clear that the petitioners are innocent and rather they tried to save the deceased.
4. Learned APP opposes the prayer for bail.
5. The prosecution case is that the deceased was burnt and later on he died. The statement of the doctor who treated the deceased is at paragraph no. 14 and the police officer is at paragraph no. 17 who recorded the fardbeyan. Both of them stated that in their presence this deceased clearly stated that this petitioner-Noor Alam and Pradeep Gupta has sprinkled kerosene upon him and set him on fire

6. Considering the specific statement, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Jainagar PS Case No. 58 of 2020, pending in the Court of learned SDJM, Koderma stands rejected.
7. Accordingly, this bail application is dismissed.
