The petitioner is apprehending his arrest in connection with Borio PS Case No.329 of 2023, for offence registered under section 414 of the IPC, section 12 of Jharkhand Bovine Animal (Prohibition of Slaughter) Act, 2005, Section 11(1)(d) of Prevention of Cruelty to Animals Act, 1960 and section 47(A), (B), (C), 49, 54, 56(A), (B), (C) of Transport of Animal Rules, 1978, pending in court of learned Judicial Magistrate First Class, Sahibganj. 3. Learned counsel for the petitioner submits that the petitioner is neither the owner nor the driver of the pick up van and the allegations are made of carrying bovine animals on the said pick up van. He submits that the petitioner is having no criminal antecedent as disclosed in paragraph no.22 of the petition. 4. Learned State counsel opposes prayer and submits that in a cruel manner the bovine animals were being carried in the said pick 2026:JHHC:10943 2 up van and that fact has come when the said pick up van met with an accident. 5. Considering that the only allegation is made against the petitioner that this petitioner has purchased the bovine animals and the petitioner is neither the owner nor the driver of the pick up van and the owner of the said pick up van has been granted anticipatory bail in ABA No.10699 of 2023 and the petitioner is having no criminal antecedent as aforesaid, the petitioner, above named, is, hereby, directed to surrender before learned court within two weeks from today, and learned court shall release the petitioner, above named, on such terms and conditions as well as sureties as the learned court may deem fit and proper. 6.
