Order 15/04/2026
1. These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No. 81/2026 registered at Police Station Bagad Tiraya, District Alwar for the offences under Sections 140(3), 126(2), 127(2), 351(2) of BNS and Sections 5(l), 5(m), 6, 9 and 10 of POCSO Act and Sections 67a, 67b of IT Act and Section 3(2)(va) of SC/ST Act.
2.
Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. It is
[2026:RJ-JP:15582] (2 of 2) [CRLMB-5231/2026] contended that victim has not alleged petitioner Deepak for committing rape with him, the main allegation is against other co- accused. The accused-petitioners are in custody since 18.03.2026 and the trial of the case may take considerable time, there are no criminal antecedents against the accused-petitioner, therefore, the bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application and contended that age of the victim at the relevant time was 11 years 4 month and victim in his statement has clearly stated that he was raped by petitioner Rohit and petitioner Deepak was also present at the place of occurrence with the other co- accused. Investigating agency has also collected a video in which co-accused were found committing sexual offence with the victim and presence of present petitioners were also seen. The victim in his statement recorded under Section 183 of the BNSS has clearly stated that petitioners were present with the other co-accused at the time of commission of offence, therefore their bail application deserves to be dismissed.
4. Heard and perused the material available on record.
5. Considering the evidence collected so far against the petitioner and statement of the victim, this court is not inclined to enlarge the accused petitioners on bail.
6. Accordingly, the present criminal misc. bail applications are hereby dismissed.
