Heard Mr. Manoj Paranjpe, learned Senior Counsel assisted by Ms. Shalini Kashyap, learned counsel for the appellant, Mr. P.R. Patankar, learned counsel appearing for respondents No.1 & 2 as well as Dr. Saurabh Kumar Pande, learned counsel appearing for respondents No.3 to 6. 2. The present intra Court appeal has been filed by the appellant against the order dated 02.01.2026 passed by the learned Single Judge in WPS No.6150 of 2014 , whereby the learned Single Judge has dismissed the batch of writ petitions as not maintainable. 3. It has been pointed out by learned counsel for the parties that in an identical matter, this Court had dismissed Writ Appeal No.113 of 2026 vide order dated 05.02.2026 observing as follows : “5. Having heard learned Counsel for the parties and upon careful perusal of the material available on record as well as the order passed by the learned Single Judge, this Court is of the considered view that no case for interference in Writ Appeal is made out. The learned Single Judge has rightly held that the dispute raised by the Appellant pertains to service conditions arising out of employment in a private unaided institution for which, an efficacious alternative remedy 3 in accordance with law is available and therefore, the Writ petition was not maintainable under Article 226 of the Constitution of India. Mere affiliation of the institution with a statutory university or issuance of a communication by the University does not, in the facts of the present case, confer a public law character so as to warrant exercise of extraordinary writ jurisdiction. 6. Accordingly, the Writ Appeal being devoid of merit is dismissed, leaving it open to the Appellant to avail such alternative remedy as may be available in law. No order as to costs.” They further submitted that since the facts and issue involved in the present case is identical to that of Writ Appeal No.113 of 2026, this appeal may also be disposed off in the same terms. 4. Having considered the rival submissions made by learned counsel for the parties and having gone through the materials on record, it is evident that the facts and issue involved in this appeal is identical to Writ Appeal No.113 of 2026, this Court deems it appropriate not to take a view other than what has been taken in Writ Appeal No.113 of 2026. 5.
