(2) Petitioner has made representation, claiming regularisation on the post of Labour/Watchman in the Forest Department, to the Principal Chief Conservator of Forest. As per the representation, petitioner served in that capacity since 2001, except for a small break in the year 2003. (3) Learned State Counsel, however, refers to the representation made by the petitioner, which on record as Annexure-5 to the writ petition, for submitting that petitioner admits in his representation that he served between 2001 to 2003. He further points out that petitioner had approached National Commission for Scheduled Castes and in reply submitted by the Divisional Forest Officer concerned to the Commission, it is mentioned that it was not the petitioner who served as daily wager in the concerned forest division, but the daily wager concerned was named as Dheeraj Kumar S/o Dharampal, who served between January 2002 to March 2002 only. (4) Without going into the issues raised by learned Counsel for the parties, this Court thinks that ends of justice would be met if the concerned authority is directed to look into the matter and take decision, as per law. Writ petition is, 2026:UHC:4369 accordingly, disposed of with liberty to petitioner to make fresh representation to the Divisional Forest Officer, Terai Central Forest Division, Haldwani. If he makes such representation within two weeks from today, decision thereupon shall be taken, as per law, within ten weeks thereafter.
