Heard Mr. Shivansh Dwivedi, learned Counsel for the petitioner and Mr. Shahsi Kant Kushwaha, learned Standing Counsel for the State respondents. 3. The instant writ petition has been filed for the following relief:- "to issue a writ order or direction in the nature of mandamus to seeking direction for early disposal of his Case No. C- , 202402000002001 Dinesh Kumar Singh Vs Rohit Kumar Singh & others under Section 24(4) of the U.P. Revenue Code, 2006 pending in the court of Commissioner Prayagraj Division, Prayagraj (respondent no. 3)." 4. Counsel for the petitioner submitted that appeal under Section 24 (4) of U.P. Revenue Code, 2006 filed on behalf of the petitioner is pending before respondent no.6/ Additional Commissioner (Judicial) Prayagraj Division Prayagraj since 30.9.2024. He further placed the order sheet of the pending proceeding in order to demonstrate that matter is not proceeding expeditiously. 5. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to respondent No.6, Versus Counsel for Petitioner(s) : Gopal Krishna, Shivansh Dwivedi, Vipul Singh Counsel for Respondent(s) : C.S.C. Dinesh Kumar Singh .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s) Additional Commissioner (Judicial) Prayagraj Division Prayagraj to consider and decide the aforementioned appeal in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties.
