Also heard Mr. B Sarma, learned Additional Public Prosecutor, Assam, appearing for the State respondent and Mr. S Hussain, learned counsel for the informant. 2. This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, Ajit @ Tailor, seeking bail in Noonmati P.S. Case No. 43/2026 under Section 87 of BNS, 2023. The petitioner is behind the bars since 20.03.2026. 3. Case diary is received. Perused the same. 4. It is submitted by Mr. Medhi, learned counsel for the petitioner that the present accused petitioner is innocent and he has not committed any such offence as alleged in the FIR. However, both the petitioner and the victim were apprehended in Pataudi, Haryana and where from, she was brought for recording her statement and the accused petitioner was also took on transit remand and thereafter, he was produced before the concerned Court. The accused petitioner is in custody since the last 59 days and hence, considering his length of detention, he may be released on bail. However, the petitioner is still ready and willing to extend his co-operation in further investigation of the case, if he is granted with the privilege of bail. 5. Mr. Sarma, learned Additional Public Prosecutor, Assam submitted in this regard that the statement of the victim has already been recorded, where from, Page No.# 3/4 it reveals that some physical relationship was there with the present accused petitioner during her stay with him. However, he submitted that till date, no section is added in that aspect nor any prayer has been made by the Investigating Officer. 6. Mr. Hussain, learned counsel for the informant submitted that the matter has amicably settled between the parties and the informant has no objection, if the petitioner is granted bail at this stage. 7. Considering the submissions made by the learned counsel for both sides, without going detail into the merit of the case and considering the statement made by the victim under Section 183 BNSS vis-à-vis the length of detention already undergone by the accused petitioner, this Court finds that further custodial interrogation may not be necessary for the purpose of investigation. Accordingly, this Court finds it to be a fit case to extend the privilege of bail to the present accused petitioner. 8. Accordingly, the accused petitioner, Ajit @ Tailor, be released on bail on furnishing a bail bond of Rs.20,000/- (Rupees Twenty Thousand) only, with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (M), Guwahati. The accused petitioner, named above, be enlarged on bail, subject to the following conditions:- (i) that the petitioner shall make himself available for interrogation by the Investigating Officer, as and when required; (ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/them from disclosing such facts to the Page No.# 4/4 Court or to any police officer; and (iii) that the petitioner shall not leave the jurisdiction of the learned CJM, Kamrup (M), Guwahati, without prior permission. 9.
