G.P. for Revenue The Court made the following: 2 W.P.No.17302 of 2026 ORDER: The writ petition is filed under Article 226 of the Constitution of India, seeking the following relief: “…to issue an order, writ or direction more particularly in the nature of Writ of Mandamus questioning the action of the respondents in proceeding with the re-survey without considering the pendency of the revenue appeal before the respondent No. 3 and the objections made by the petitioner through legal notice dated 05.06.2026 and in respect of property to an extent of Ac. 1.48 cents in Sy. No. 162- 1, Ac. 0.69 cents in survey No. 162-3, Ac. 1.33 cents in Sy. No. 163-1 and Ac. 2.00 cents in Sy. No. 141-1 situated at Kamarupalle village, Anantapur Rural mandal, Anantapur district as illegal, arbitrary, beyond jurisdiction and violative of Articles 14, 19 (1) (g), 21 and 300-A of the Constitution of India and consequently direct the respondents not to conduct re-survey till finalisation of appeal before the respondent No. 3 by considering the representation / legal notice dated 05.06.2026 made by the petitioner and pass…” 2. The case of the petitioner, stated briefly, is as follows: a. The petitioner is an absolute owner and possessor of the subject land. The petitioner inherited the said properties from his parents and maternal aunt after their demise vide registered deeds document Nos. 276 and 17075 of 2006 dated 15.12.2006. Consequently, the revenue authorities mutated petitioner’s name in revenue records with regard to some of the properties and mistakenly mutated third party names with regard to the subject land. The petitioner filed an appeal before the respondent No. 3 in the year 2025 and the same is pending for adjudication. While the matter stood thus, the revenue authorities are trying to conduct survey in the name of re-survey and to continue the 3 W.P.No.17302 of 2026 names of third parties with regard to the subject land. Hence, this writ petition was filed. 3. The learned Assistant Government Pleader for Revenue placed on record a copy of written instructions of the respondent No. 4, vide Rc. No. B / 375 / 2026, dated 29.06.2026, wherein it is mentioned as follows: As per the R.S.R. of Kamarupalle village of Ananthapuramu Rural mandal, the land to an extent of Ac.1.48 cents in Sy. No. 162-1, Ac.0.69 cents in Sy. No. 162-3, Ac. 1.33 cents in Sy.No. 163-1, and Ac.2.00 cents in Sy.No.141-1, and the webland details, are given as follows: Sl.No. Sy.No. Extent in Acres Classification Name of the pattadar in Adangal Khata No. 1. 162-1 0.74 Dotted Harijana Kondakka S/o. Malayya 552 A R.O.R. appeal regarding the deletion of webland entries of the above-scheduled lands has been filed by the petitioner before 4 W.P.No.17302 of 2026 the Revenue Divisional Officer, Ananthapuramu, and the petition was not taken on file till date. In order for Ananthapuramu District to be re-surveyed in all the villages as usual, Kamarupalli village was taken up for re-survey as per the schedule fixed by the Joint Collector, Ananthapuramu. Ground truthing / ground validation of the pattadars has been conducted through the re-survey, and their boundaries will be demarcated as per their enjoyments. Furthermore, after due procedure and process as per Section 13 of the Andhra Pradesh Survey and Boundaries Act, the resurvey will be completed. Presently, the resurvey of Kamarapalli village is under process. No changes have been proposed for the updation of webland in the scheduled land, as an objection petition was filed by the petitioner on 05.06.2026, and the scheduled lands have been kept exactly as they were before the re-survey. Only the measurements of the lands have been demarcated on the ground as part of the re- survey. 4. In view of the above written instructions, the learned counsel for the petitioner requested to dispose of the writ petition recording the above instructions as part of the order. 5. Accordingly, the writ petition is disposed of recording the written instructions as part of this order. No costs.
