Vinod S/o. Chandrasekharan, No.7, Big Street, Tiruannamalai Town, Tiruvannamalai District. 2. Sudha W/o. Vinod, No.7, Big Street, Tiruvannamalai Town, Tiruvannamalai District. ..Petitioner(s) Vs 1. State Rep.by, The Inspector of Police, Tiruvannamalai Town Police Station, Tiruvannamalai. Cr.No.732/2023. Final Report No.170/2024. 2. V.Raveendaran S/o. Velusamy, No.7, Big Street, Tiruvannamalai Town, Tiruvannamalai District. ..Respondent(s) Prayer: Petition filed under Section 482 of Cr.P.C., praying to call for the entire records pertaining to STC.No.1367 of 2024 on the file of the Judicial Magistrate No.1, Tiruvannamalai and quash the same. https://www.mhc.tn.gov.in/judis CRL OP No. 21247 of 2026 __________ Page2 of 5 For Petitioner(s): Mr.R.Natarajan For Respondent(s): Mr.M.Mohamed Riyaz Government Advocate (Crl. Side) for R1 ORDER The prayer in this Criminal Original Petition is to quash the S.T.C.No.1367 of 2024 on the file of the learned Judicial Magistrate No.1, Tiruvannamalai. 2. Upon considering the allegations, it can be seen that the case of the prosecution is that the petitioners being the husband and wife have attacked the de-facto complainant with hands and caused simple injury and also obscenely abused and intimidated the de-facto complainant. 3. The learned counsel would argue with reference to the fact that the alleged abuse will not even make out an offence under Section 294(b) and when the civil suit is pending between the parties, it will also not amount to an intimidation, considering the background of the case. In any event with reference to the offence under Section 323 IPC, I find that there is prima facie materials in the form of doctor’s evidence which is also included in the final https://www.mhc.tn.gov.in/judis CRL OP No. 21247 of 2026 __________ Page3 of 5 report. The learned counsel would counter the same by saying that in the FIR, three persons were said to have been assailants, whereas the final report is silent about the same. The same cannot be a ground for quash but it can be a ground to cross examine the prosecution witnesses and all the grounds can be taken during the course of the trial. Finding some material as against the petitioner to proceed, I am of the view that it is not a fit case to be interfered at the quash stage. As such, the Criminal Original Petition stands disposed of. Consequently, connected Miscellaneous Petition is closed. 4.Considering the nature of dispute between the parties and that civil dispute is pending, the presence of the petitioners before the trial Court shall stands dispensed with except for the necessary hearings as may be insisted upon by the trial Court. 5. It is left open to the petitioner to raise all the grounds during the course of trial before the trial Court and the trial Court shall consider all the grounds from being in any manner influenced by the observations made by this Court in this order. 05-08-2026 Neutral Citation: Yes/No DP https://www.mhc.tn.gov.in/judis CRL OP No. 21247 of 2026 __________ Page4 of 5 To 1.
